1. Agreement to these terms
DividendProjection.com (the "Site") is owned and operated by Dividend Empire LLC ("we," "us" or "our"). By accessing or using the Site, you agree to these Terms of Use, our Disclaimer and our Privacy Policy, which are part of these terms. If you don't agree, please don't use the Site.
You must be at least 18 years old, or the age of majority where you live, to use the Site.
2. Educational use only
The Site, including its calculator, projections, charts, fund data, expense comparisons and all other content, is provided for general informational and educational purposes only. It is not financial, investment, tax, legal or accounting advice, and it is not a recommendation to buy, sell or hold any security.
We are not a registered investment adviser, broker-dealer or tax professional, and no professional or fiduciary relationship is created by your use of the Site. You are solely responsible for your investment decisions and should consult a qualified professional before making them.
3. Projections and data
Projections are hypothetical and rely on simplified assumptions described in our Disclaimer, including a constant share price and constant yield. They are not predictions or guarantees of future results. Fund data is updated regularly but may be inaccurate, incomplete or delayed, and third-party averages used for comparisons may be out of date. You use all projections and data at your own risk.
4. Sponsorships
Our websites are supported in part by sponsorships from ETF issuers and other companies. Sponsored content or placements will be clearly identified. A sponsorship is not an endorsement or recommendation of any product, and sponsors have no control over the calculator's methodology, data or results.
5. Acceptable use
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Site for your own non-commercial purposes. You agree not to:
- Scrape, crawl, harvest or copy the Site's data or content by automated means, or use it to build a competing product or database
- Reproduce, republish, resell or commercially exploit the Site or its data without our written permission
- Frame or mirror the Site, or present it as your own
- Reverse engineer, decompile or attempt to access the Site's source data or systems in unauthorized ways
- Interfere with or disrupt the Site, overload it, or introduce malicious code
- Use the Site for any unlawful purpose, or to mislead others about an investment
- Remove or alter any copyright, trademark or disclaimer notices
7. Intellectual property
The Site and its original content, design, code, graphics, text, data compilations and branding, including the DividendProjection name and logo, are owned by Dividend Empire LLC or its licensors and are protected by copyright, trademark and other laws. Except for the limited license above, no rights are granted to you. Fund names and tickers belong to their respective owners and are used for identification only.
If you send us feedback or suggestions, we may use them freely without any obligation to you.
8. Third-party sites and services
The Site links to and relies on third-party websites and services, including data sources, fund issuers, Google services and GitHub. We don't control them and aren't responsible for their content, availability, accuracy or practices. Your use of them is governed by their own terms.
9. No warranties
The Site and all content, tools and data are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, title and non-infringement. We don't warrant that the Site will be uninterrupted, secure or error-free, that data will be accurate or current, or that any projection will reflect actual results.
10. Limitation of liability
To the fullest extent permitted by law, Dividend Empire LLC and its owners, members, employees, contractors, sponsors and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any investment losses, lost profits, lost data or other losses, arising out of or related to your use of, or inability to use, the Site or any content, projection or data on it, even if we've been advised such damages are possible. Our total liability for any claim related to the Site will not exceed one hundred U.S. dollars ($100).
Some jurisdictions don't allow certain limitations of liability, so some of the above may not apply to you. In that case, our liability is limited to the smallest amount the law allows.
11. Indemnification
You agree to defend, indemnify and hold harmless Dividend Empire LLC and its owners, members, employees and contractors from any claims, damages, losses, liabilities and expenses, including reasonable attorneys' fees, arising from your use of the Site, your violation of these terms, or your violation of any law or the rights of any third party.
12. Changes to the Site and these terms
We may change, suspend or discontinue any part of the Site at any time without notice, including features, funds covered and data sources. We may also update these terms. When we do, we'll change the "Last updated" date above. Continuing to use the Site after changes take effect means you accept the updated terms.
13. Governing law and disputes
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. You agree that any dispute arising from or related to these terms or the Site will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction of those courts. Any claim must be brought within one year after it arises, or it is permanently barred, to the extent permitted by law.
14. General
These terms, together with our Disclaimer and Privacy Policy, are the entire agreement between you and us about the Site. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision isn't a waiver of it. You may not assign these terms; we may assign them, including in connection with a sale of our business.
